Deputyships

Where someone loses the capacity to manage their own affairs with no valid power of attorney in place, an application can be made to the Court of Protection to appoint a deputy. The deputy, once appointed, can manage that person’s affairs on their behalf.

Our team is one of the most experienced in the South East. We:

  • advise on and assist with the process and applications for appointing a deputy
  • advise deputies of their obligations in accordance with the Mental Capacity Act 2005 and the accompanying Code of Practice
  • assist deputies with other Court of Protection applications which require court approval, including applications for statutory Wills, and gifting on behalf of the person who has lost capacity
  • prepare accounts for deputies
  • act as deputy where there is no one else suitable to act – one of our partners, Glen Miles, is one of only 60 people in England and Wales on the Court of Protection’s panel of approved deputies
