Alternative Dispute Resolution (ADR) is a very effective legal tool and a route that must be explored if you are involved in a dispute. It is a compelling alternative to litigation, which can consume significant management time and unwelcome legal costs. Not only is the outcome of litigation uncertain, it often fails to provide the best commercial remedy.
ADR adopts a less adversarial approach to resolving disputes and can therefore help to preserve ongoing business relationships. It allows parties to agree workable commercial solutions and control the time and cost invested in the dispute by avoiding the rigid litigation process.
The most frequently used forms of ADR are arbitration, adjudication, mediation or negotiation.
Other options include early neutral determination and expert determination.
The courts are so persuaded of its qualities that ADR is now a compulsory consideration in all court proceedings. Any unreasonable refusal to mediate can have severe cost consequences at trial.
