Immigration

Employment lawyers who can guide you through the maze of immigration rules and assist you in your quest to employ the best

The Points Based System for scoring potential overseas workers has been in place for several years, yet employers are still wary of taking on workers who are not UK/EU Nationals for fear of falling foul of the UK immigration system and finding themselves open to a fine.

The UK Border Agency’s website presents vast amounts of information to help employers make sense of it all, but this too can be a daunting and challenging process. For organisations in specialist industries that need to appoint people with particular skills, the process can prove an expensive and energy-sapping nightmare.

You need someone with first-hand knowledge who can guide you through and avoid the pitfalls.

We can assist you through the immigration system providing support from a business perspective.

Our advice includes detailing:

  • which of the tiers your potential overseas applicant should apply under
  • whether your potential applicant is likely to meet the points required for that Tier
  • whether you will be required to be a sponsor for that applicant
  • the process to become a sponsor
  • whether an overseas applicant who already has permission to work in the UK will require additional permissions to take up employment with you
  • the processes you should put in place to ensure that every one of your employees has the right to work in the UK
  • advice as to what to do if an overseas employee absconds
  • advice on what to do if you discover that you have inadvertently taken on an employee who does not have the right to work in the UK.
