A Consent Order is an agreement between separating parties that covers how all asset types will be divided. It usually includes property, pensions and trusts, and also covers spouse and child maintenance. Inheritance is also included but future claims are usually removed.
The Consent Order is a legally binding document which should be drawn up by a Solicitor to be sealed in court. Once drafted, the Order is signed by both parties after financial disclosure, and then submitted for review and approval by a Judge. The Consent Order is made effective once the Decree Absolute has been made.
