Children

Where children are involved, each parent and family member must put the child’s welfare first in all decisions that need to be made.  With some exceptions the rules in respect of arrangements for children are the same whether the parties are married or not.

In most cases the Court does not have automatic involvement in arrangements for the children, and generally adopts a non-interventionist approach. Only if agreement cannot be reached directly between the parents does a specific application need to be made to the Court in which event the child’s welfare will be the paramount consideration.
